The Immigration Reform and Control Act (IRCA) makes it illegal to hire and employ illegal aliens. Employers must verify identification and workplace eligibility for all hires by completing I-9 Forms.
Managers must work with HR to ensure that I-9 Forms are properly completed and updated so that an employee’s authorization to work in the United States is current at all times. It is important, however, never to confuse the law’s requirements with potential discrimination. Never ask about an applicant’s nationality prior to hire and do not require completion of an I-9 before a formal employment offer and acceptance.
